Operating instructions

The operator of the distillery for producing fruit distillation (further on only called distillery) is issuing operating instructions in accordance with the law of the NR SR no. 467/2002 statute, on producing and putting alcohol on the market in accordance with later regulations, Order of the Ministry of Agriculture of the Slovak Republic no. 653/2002 statute on operating a distillery factory for fruit distillation., law of the NR SR no. 105/2004 statute on the consumer tax from alcohol in accordance with later regulations and the Order of the Ministry of Finance of the Slovak Republic no. 226/2004 statute, in which they state the details concerning requirements on the arrangement of technological equipment for producing, processing and transporting alcohol, controlling the amount of alcohol, assessing the amount of alcohol in storage and on the way that the alcohol is supposed to be registered.
§ 1
It is only possible to produce a distillate from fruit grown in the mild climate zone, from its ferments, from the fruits of the grapevines in a fresh state or in a fermented state including fruit wines and grape wines, which do not include any sugary or any other foreign mixture (further on only called “ferment‘‘).
§ 2
The operator of the distillery provides the service of distilling alcohol for growers, but only out of the ferments brought by the growers, not from the sources of the operator.
§ 3
The manufacturing period in the distillery is from the 1. July of the year until the 30. June of the next year. The start of producing distillates will be stated by the operator in every manufacturing period.
§ 4
1. The operator of the distillery will only accept the ferment for further processing on the basis of a written request from the grower, requesting the production of a distillate. The operator will provide the grower with a template of the request letter.
2. The operator will keep files of the received requests for the production of the distillate and will negotiate the time of the production with the grower.
3. If due to reasons arising on the grower’s part will not enable him to adhere to the negotiated production time, he is obliged to give notice about this to the operator and agree on a new time of production.
4. After a mutual agreement the operator will allow the grower to store his ferments in the areas of the distillery.
5. The operator is entitled to refuse to accept ferments in containers made out of metal, in containers which are galvanized or other metal containers, which have other surface treatment, in plastic containers, which were not intended to be used for food industry purposes, or ferments of which the smell or tastes indicates signs that there might be unwanted foreign and harmful additional mixtures, which could influence the quality of the distillate or devalue the technological equipment of the distillery.
6. When accepting the ferments, the operator has to check first of all its amount, smell, taste and also the type of wrapping, or whether the ferment is not devalued and can not be further used to produce a distillate.
In case, the operator finds out that the ferment is inappropriate for the production of a distillate, he will request that the grower get expert analysis of this ferment. If the grower will not do so or refuses to do so, the operator will refuse to accept the ferment and refuse to process it.
§ 5
1. Taking into account, that using production equipment of the distillery makes it possible to distill only the amount of 300 liters of ferment during one distillation, and the grower has a smaller amount of ferment (under 200 L) and he requests the processing of his ferment, he is obliged to respect that his ferment will be processed with a ferment of the same kind from another grower. The operator then can not be responsible for the quality of the produced distillate from this kind of mixed ferment: the produced distillate will then be divided between these growers in proportion to the amount of ferment they supplied.
2. After the production of the distillate, the grower is obliged to come at the latest ten days after the distillate has been produced. When getting the distillate the grower will pay the price for the service according to the operator‘s price list and the consumer tax from alcohol.
3. If the grower does not come to take the produced distillate within the stated time period, the operator is obliged to tell the customs office as the administrator of the consumer tax from alcohol and then the alcohol will be dealt with according to the law.
4. The grower is obliged to take the produced distillate into his own containers, because the operator does not provide these, and confirm that he took the produced distillate with his signature. It is recommended that the distillate be taken in glass containers, because the operator is not to be held responsible for the quality of the distillate if stored in other containers, not made out of glass.
5. The operator will give the grower the opportunity to degust the distillate, which is being produced, check its amount and its scaling, if he requests to do so.
§ 6
The grower can enforce the reclamation right in the area of the distillery according to the reclamation order.
§ 7
1. During the production of the distillate the grower has to stay in the designated area, from which he has the opportunity of watching the production method.
2. The growers do not have the right to enter the areas of the production facilities arbitrarily. If the operator allows them to enter they are forbidden to touch parts of the equipment, because of the possibility that an accident may occur, they can not touch the customs fastening (seals) and measuring equipment.
3. The growers are obliged to respect the instructions of the operator, or his responsible employees, adhere to these operating instructions in the sections which apply to them, or else they will have to leave the areas of the distillery.
§ 8
1. The employees of the operator are obliged to adhere to the regulations on health safeguarding and work safety, fire safety regulations, hygienic regulations and regulations which result from labor relations.
2. The employees of the operator are obliged to use personal safety devices and appropriate work items and tools.
3. Drinking water and sanitary facilities are provided for the employees and the growers during the operating times of the distillery.
§ 9
1. Before the ferments are transported to the distillery, the grower is obliged to remove any impurity from the surface of the ferments in the container, to prevent their mixing with other ferments. In the case that they are not removed before the transport, the grower is obliged to remove them immediately after transporting the ferments to the distillery, and after they are removed to take them away from the distillery in his own containers
2. The operator provides the liquidation of burnt residue in accordance with the regulations on how to handle garbage. The expenses for the liquidation of burnt residue are included in the prices for the provided services.
§ 10
These operating instructions are to be located in an area with free entry. Every grower, who is interested in the services provided by the distillery, is obliged to acquaint himself with the content by reading the instructions and then follow them in the area of the distillery.
§ 11
Violation of these operating instructions on the part of the growers or other people, who are in the distillery, will result in their removal from the areas of the distillery and its premises.
§ 12
These operating instructions come into effect on the 2. September 2008
